The following hearing of the International Court of Appeal took place in Paris on Tuesday 10 September 2013:

Appeal lodged by the Russian Automobile Federation (RAF) on behalf of its licence-holder, G-Drive Racing, against decision N36 of the Panel of the Stewards of the Meeting of Le Mans (France) counting towards the 2013 FIA World Endurance Championship (WEC)

On 23 June 2013, in post-race scrutineering of Car n26, the capacity of the fuel tank was checked and found to be in excess of 75ltrs which is the maximum fuel capacity prescribed by the relevant Technical Regulations.

On the basis of the report of the Technical Delegate, the Stewards of the Meeting decided to exclude Competitor n26 from the Race.

Decision of the International Court of Appeal

The Court, after having heard the parties and examined their submissions, decided to:

1. Declare that G-Drive Racing committed a breach of article 6.5.1 of the 2013 Technical Regulations for Prototype;

2. Uphold the Decision n36 of the Race Stewards of the Meeting in Le Mans counting towards the 2013 FIA World Endurance Championship (WEC);

3. Confirm the exclusion of G-Drive Racings car n26 from the Meeting in Le Mans counting towards the 2013 FIA World Endurance Championship (WEC);

The International Court of Appeal was presided over by Mr Jan STOVICEK (Czech Republic), and included Mr Jean GAY (Switzerland), Mr Richard McLAREN (Canada) and Mr Erich SEDELMAYER (Austria).
