2024 FIA European Rally Championship – ICA decision – Hearing 18 07 24 – Miko Marczyk Team
The following hearing of the International Court of Appeal took place on 18 July 2024 in Geneva:

Case ICA-2024-05: Appeal lodged on behalf of Miko Marczyk Team against Decision No. 6 dated 4 May 2024 of the Stewards of the Rally Islas Canarias 2024 counting towards the 2024 FIA European Rally Championship (ERC)
On 4 May 2024, during the Rally Islas Canarias (Spain) counting towards the 2024 FIA European Rally Championship (ERC), the Stewards received a report from the FIA Technical Delegate about Car No. 6 (Crew: Miko Marczyk / Szymon Gospodarczyk). According to this report, the competitor used one tyre that was not on the list provided from the registered tyre supplier which represented a breach of Art. 13.3 of the 2024 FIA Regional Rally Sporting Regulations V1A in conjunction with Art. 7.1 of the Supplementary Regulations. The Stewards therefore decided to impose a two-minute time penalty.
On 8 May 2024, the Appellant lodged an appeal against the Stewards’ Decision before the ICA.
Decision of the International Court of Appeal
The Court, after having heard the parties and examined their submissions, decided to:
- uphold partially the appeal;
- set aside the Decision No. 6 of the Stewards of the 2024 Rally Islas Canarias counting towards the 2024 FIA European Rally Championship;
- sanction the Mirko Marczyk Team with a fine of 10,000 Euros.
The International Court of Appeal was presided over by Mr Rui BOTICA SANTOS (Portugal), and included, Mr Marcelo COELHO DE SOUZA (Brazil), Mr Gary CROTTY (USA) and Mr Thierry JULLIARD (Switzerland).
