ICA Decision - Hearing 17 September, 2018 - World Touring Car Cup (WTCR)

The following hearing of the International Court of Appeal took place in Paris:

Appeals brought by Münnich Motorsport GMBH and Boutsen Ginion Racing against the Stewarts’ decisions No. 30, 31 and 32 dated 14 July 2018, taken during the Race of Slovakia counting towards the 2018 FIA World Touring Car Cup

Appeal brought by Münnich Motorsport GMBH

On 14 July 2018, on the basis of a report from the FIA Technical Delegate which stated that car No. 86 (Driver E. Guerrieri, Competitor Münnich Motorsport GMBH) has been found not respecting the maximum boost pressure during the Qualifying Session, the Stewards decided to disqualify the car from this Session and to allow it to take part in Races 2 and 3 from the last position, considering that the car of the competitor was in breach of the 2018 Technical Regulations of the FIA WTCR Technical Regulations.

On 18 July 2018, Münnich Motorsport GMBH decided to appeal the decision No. 30 taken by the Stewards during the Race of Slovakia.

Appeal brought by Boutsen Ginion Racing

On 14 July 2018, on the basis of a report from the FIA Technical Delegate which stated that car No. 9 (Driver T. Coronel, Competitor Boutsen Ginion Racing) has been found not respecting the maximum boost pressure and not respecting the maximum engine speed values during the Qualifying Session, the Stewards decided to disqualify the car from this Session and to allow it to take part in Races 2 and 3 from the last position, considering that the car of the competitor was in breach of the 2018 Technical Regulations of the FIA WTCR Technical Regulations.

On 18 July 2018, Boutsen Ginion Racing decided to appeal the decision No. 31 taken by the Stewards during the Race of Slovakia.

On 14 July 2018, on the basis of a report from the FIA Technical Delegate which stated that car No. 63 (Driver B. Lessennes, Competitor Boutsen Ginion Racing) has been found not respecting the maximum boost pressure and not respecting the maximum engine speed values during the Qualifying Session, the Stewards decided to disqualify the car from this Session and to allow it to take part in Races 2 and 3 from the last position, considering that the car of the competitor was in breach of the 2018 Technical Regulations of the FIA WTCR Technical Regulations.

On 18 July 2018, Boutsen Ginion Racing decided to appeal the decision No. 32 taken by the Stewards during the Race of Slovakia.

Given the close connection between these three cases, it was decided that they would be jointly examined during the same hearing.

Decision of the International Court of Appeal

The Court, after having heard the parties and examined their submissions:

-    Quashed Decision No. 30 taken by the Stewards of the Race of Slovakia on 14 July 2018;
-    Confirmed Decisions No. 31 and 32 taken by the Stewards of the Race of Slovakia on 14 July 2018 in that they sanction through disqualification the Appellant’s failure to respect the maximum engine speed value;
-    Pronounced the exclusion of the Appellant Boutsen Ginion Racing’s cars No. 9 and 63 from Races 2 and 3 of the Race of Slovakia counting towards the 2018 FIA World Touring Car Cup (WTCR).

The International Court of Appeal was presided over by Mr Philippe NARMINO (Monaco), and included Mr Jean LUISI (France), Mr Fabio MATTEI (Italy) and Mr Patrik RAEDERSDORF (Switzerland).
