The following hearing of the International Court of Appeal took place in Paris on Friday 15 February 2013:

Appeal lodged by the Confederaçao Brasileira de Automobilismo (CBA) on behalf of its licence-holder, Sergio Santos Sette Câmara Filho, against a decision of the French National Court of Appeal dated 4 December 2012 – Event run at Saint-Laurent de Mure (France) on 21 October 2012 and counting towards the 2012 Category X30 Junior competition
 
Reminder of the facts
 
On 21 October 2012 the panel of the stewards decided to impose a 10 second time penalty to the kart N° 129 (driver Jules Bollier) in accordance with article 2.24 of the CIK-FIA regulations, for having caused a collision with Sergio Santos Sette Câmara Filho.  As a result, Jules Bollier finished 6th and Sergio Santos Sette Câmara Filho finished 1st.
 
On 22 October 2012 Jules Bollier notified his intention to appeal the decision of the Panel of the Stewards before the French National Court of Appeal.
 
On 4 December 2012, the French National Court of Appeal decided to withdraw the decision of the Panel of the Stewards.
 
On 13 December 2012, the Confederaçao Brasileira de Automobilismo (CBA) on behalf of its licence-holder, Sergio Santos Sette Câmara Filho, decided to appeal this decision before the International Court of Appeal
 
Decision of the International Court of Appeal
 
The Court, after having heard the parties and examined their submissions, decided to:
 
- quash the Contested Ruling returned by the FFSA National Court of Appeal on 4 December 2012 and to confirm Decision n°41 taken by the Panel of Stewards on 21 October 2012.
 
The International Court of Appeal was presided over by Mr Philippe ROBERTI DE WINGHE (Belgium), and included Mr Javier BONE MATHEU (Spain), Mr Francesco DE BEAUMONT (Italy) and Mr Pierre TOURIGNY (Canada).
