On 25 July 2010, at the Grand Prix of Germany, the Stewards of the meeting found an infringement by the Scuderia Ferrari to the prohibition of team orders interfering with a race result and then decided to impose a fine of $100,000 and to forward the dossier to the World Motor Sport Council for further consideration.
The Judging Body of the World Motor Sport Council held an extraordinary hearing in Paris on 8 September 2010 to examine this matter.
After an in depth analysis of all reports, statements and documents submitted, the Judging Body has decided to confirm the Stewards’ decision of a $100,000 fine for infringing article 39.1 of the Sporting Regulations and to impose the payment of the costs incurred by the FIA.
The Judging Body has also acknowledged that article 39.1 of the Sporting Regulations should be reviewed and has decided to refer this question to the Formula One Sporting Working Group.

Proceedings
In March 2010 at Bahrain at the initiative of the FIA President, the World Motor Sport Council adopted a new transitional disciplinary procedure, in order in particular to ensure the separation between the prosecuting body and the judging body. At the General Assembly on 5 November 2010, a more global reform of the FIA judicial system will be submitted for approval, including in particular the creation of an International Tribunal which will exercise the disciplinary power in the 1st instance in place of the World Motor Sport Council.
In application of this new procedure, previously applied within the context of the US F1 case, the FIA President exercises the role of prosecuting body. As such, he has the authority to notify any person being prosecuted of the grievances brought against him and to submit the matter to the Judging Body of the World Motor Sport Council, chaired by the Deputy President for Sport, Mr Graham Stoker.
The Deputy President for Sport has the power to proceed with an investigation and, within this context, to designate a reporter from among the members of the World Motor Sport Council.
In the present case, the Deputy President for Sport designated Mr Lars Österlind, a member of the World Motor Sport Council, as reporter. Mr Österlind’s report was forwarded to the Scuderia Ferrari Marlboro as the party being prosecuted.
Prior to the hearing, the members of the Judging Body of the World Motor Sport Council received all the documents in the case, including the observations submitted by the Scuderia Ferrari Marlboro.
The FIA President did not attend the hearing but was represented by Maître Jean-Pierre Martel from the law firm Orrick Rambaud Martel.
The hearing before the Judging Body of the World Motor Sport Council, assembled on 8 September 2010 in an extraordinary meeting, was chaired by the Deputy President for Sport and allowed the hearing, in person, of Mr Stefano Domenicali, Team Principal of the Scuderia Ferrari Marlboro, assisted by lawyers, Mr Henry Peter and Nigel Tozzi. The World Motor Sport Council had the possibility to join the drivers Mr Fernando Alonso and Mr Felipe Massa via videoconference.

Lors du Grand Prix d'Allemagne du 25 juillet 2010, les Commissaires Sportifs ont constaté une infraction de la Scuderia Ferrari à l’interdiction des consignes d’équipe interférant avec le résultat d’une course et ont ainsi décidé d'infliger une amende de 100 000 $ et de soumettre le dossier au Conseil Mondial du Sport Automobile pour examen.
L’Organe de Jugement du Conseil Mondial du Sport Automobile a tenu une audience extraordinaire le 8 septembre 2010 à Paris afin d’examiner cette affaire.
Après une analyse approfondie de tous les rapports, déclarations et documents soumis, l’Organe de Jugement a décidé de confirmer la décision des Commissaires Sportifs d’infliger une amende de 100 000 $ pour infraction à l’Article 39.1 du Règlement Sportif et d’imposer le paiement des frais engagés par la FIA.
L’Organe de Jugement a également relevé que l’Article 39.1 du Règlement Sportif devrait être révisé et a décidé de renvoyer cette question devant le Formula One Sporting Working Group.

Procédure
En mars 2010 à Bahreïn à l’initiative du Président de la FIA, le Conseil Mondial du Sport Automobile a adopté une nouvelle procédure disciplinaire transitoire afin notamment d’assurer la séparation entre l’autorité de poursuite et l’organe de jugement. Lors de l’Assemblée Générale du 5 novembre 2010 une réforme plus globale du système juridictionnel de la FIA sera soumise pour approbation, laquelle prévoit notamment la création d’un Tribunal International qui exercera le pouvoir disciplinaire de 1ère instance en lieu et place du Conseil Mondial du Sport Automobile.
En vertu de cette procédure, appliquée précédemment dans le cadre de l’affaire US F1, le Président de la FIA exerce la fonction d’organe de poursuite. A ce titre, il a autorité pour notifier à toute personne poursuivie les griefs qui lui sont reprochés et pour saisir l’Organe de Jugement du Conseil Mondial du Sport Automobile présidé par le Président Délégué pour le Sport, M. Graham Stoker.
Le Président Délégué pour le Sport a pouvoir pour procéder à une instruction et pour désigner dans ce cadre un rapporteur parmi les membres du Conseil Mondial du Sport Automobile.
Dans la présente affaire, le Président Délégué pour le Sport a désigné M. Lars Österlind, membre du Conseil Mondial du Sport Automobile, en qualité de rapporteur. Le rapport de ce dernier a été transmis à la Scuderia Ferrari Marlboro en tant que personne poursuivie.
Les membres de l’Organe de Jugement du Conseil Mondial du Sport Automobile ont été destinataires préalablement à l’audience de l’ensemble des documents versés au dossier, dont les observations produites par la Scuderia Ferrari Marlboro.
Le Président de la FIA n’était pas présent à l’audience mais représenté par Maître Jean-Pierre Martel du Cabinet Orrick Rambaud Martel.
L’audience devant l’Organe de Jugement du Conseil Mondial du Sport Automobile, réuni le 8 septembre 2010 en séance extraordinaire, a été présidée par le Président Délégué pour le Sport et a permis l’audition, en personne, de M. Stefano Domenicali, Team Principal de la Scuderia Ferrari Marlboro, assisté de ses avocats, Maître Henry Peter et Maître Nigel Tozzi. Le Conseil Mondial du Sport Automobile avait la possibilité de joindre les pilotes M. Fernando Alonso et M. Felipe Massa par vidéoconférence.
