 International Court of Appeal - Decision

The FIA International Court of Appeal met in Paris on Thursday, June 12, 2008, to examine an appeal lodged by the Royal Automobile Club de Belgique (RACB) on behalf of its licence-holder Prospeed Competition against decision N°28 taken by the Panel of the Stewards of the Meeting concerning the event that was run at Monza (Italy) on 18 May 2008 and counting towards the 2008 FIA GT Championship.

 

The competitor AF Corse (car N°50 driven by Mr Vilander and Mr Bruni) lodged a protest which claimed that the refuelling procedure had not been respected by the competitor Prospeed Competition (car N°61 driven by Mr Collard and Mr Westbrook).  After having viewed video footage provided by the competitor AF Corse, the Stewards decided to exclude car N°61 from the results of the race.

 

Having heard the explanations of both parties and having examined the various documents and other evidence, the Court found that certain material facts had not been proved, quashed the Stewards’ decision and reinstated car N°61 in the classification.

 

The International Court of Appeal was presided over by Mr Laurent ANSELMI (Monaco), and composed of Mr Harry DUIJM (The Netherlands), Mr Thierry JULLIARD (Switzerland) and Mr Dieter ROSSKOPF (Germany).
