International Court of Appeal
Due to common factual background, the two following hearings of the International Court of Appeal will take place in Paris on the same day:
1/ Appeal lodged by the Motor Sports Association (MSA) on behalf of the British Automobile Racing Club (BARC) - the Organising Committee of Formula BMW Europe 2009 – against the decision of the Tribunal Nacional de Apelación y Disciplina de la Real Federación Española de Automovilismo (RFEA) dated 21 September 2009
At the race run at Hungaroring (Hungary) on 26 July 2009, the oil pressure of cars N°15, 16 and 17 of competitor Mücke Motorsport GmbH was found to be lower than expected. A subsequent inspection indicated that the springs used on the oil pressure relief valves in all three cars differed from the springs used in stock BMW engines as required by the regulations. The Stewards, meeting at the location of the next event (Valencia) on 20 August 2009 declared that cars N°15, 16 and 17 were not in conformity and decided to impose a fine of €1,000 for each car and suspend the three cars of Mücke Motorsport GmbH from the Valencia race on 21-23 August 2009. They also decided that the matter should be considered by the Organising Committee.
The competitor Mücke Motorsport GmbH appealed also the above-mentioned Stewards’ decision to the Spanish National Court of Appeal. The Spanish Court on 21 September 2009 allowed the appeal in part, as it considered that cars N°15, 16 and 17 were not in conformity, but held that the Stewards who took the decision in Valencia were not entitled to do so as they were not the Stewards who were present in Hungaroring.
The BARC decided to appeal the decision of the Spanish National Court of Appeal to the International Court of Appeal.
2/ Appeal lodged by the Deutscher Motor Sport Bund e.V. (DMSB) on behalf of its competitor Mücke Motorsport GmbH against the decision of the Organising Committee of Formula BMW Europe 2009 taken on 20 August 2009 during the race of Valencia (Spain) and counting towards the 2009 Formula BMW Europe
At the Valencia race on 20 August 2009 and on the basis of the Stewards’ findings, the Organising Committee added to the Stewards’ penalty and also suspended the competitor Mücke Motorsport GmbH from the next race in Spa-Francorchamps, run on 28-30 August 2009.
Mücke Motorsport GmbH has appealed the decision of the Organising Committee to the International Court of Appeal.
